By using the www.swapmamascanada.com web site ("Swap Mamas"), you are agreeing to be bound by the following terms and conditions:

OVERVIEW
Swap Mamas facilitates swaps among the members of this service. You expressly agree that use of Swap Mamas is at your own risk. You must be 18 years of age or older to use the Swap Mamas service. Content posted to Swap Mamas is solely the opinion and responsibility of the user posting the message. Swap Mamas expects that all users will post respectful and courteous content. Swap Mamas takes no responsibility and assumes no liability either for the content posted on the site, or for your communications and relationships with other Swap Mamas members.

PRIVACY POLICY
Swap Mamas does not, and will never, give, sell, or rent your personal information to third parties. Swap Mamas views protection of users' privacy as a very important community principle.

General Terms
1. You must be 18 years and older to use this site. You are responsible for any activity that occurs under your username.
2. You are responsible for keeping your password secure.
3. You must not abuse, harass, threaten, impersonate or intimidate other Swap Mamas users.
4. You may not use the Swap Mamas service for any illegal or unauthorized purpose. Users agree to comply with all local laws regarding online conduct and acceptable content.
5. You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links that you submit, post and display on the Swap Mamas site.
6. You must not modify, adapt or hack www.swapmamas.com or modify another web site so as to falsely imply that it is associated with Swap Mamas.
7. You must not create or submit unwanted email or spam to other Swap Mamas members.
8. You must not transmit any worms or viruses or any code of a destructive nature.
9. You must not, in the use of Swap Mamas, violate any laws in your jurisdiction. Violation of any of these agreements will result in the termination of your Swap Mamas account. While Swap Mamas prohibits such conduct and content on its site, you understand and agree that Swap Mamas is a venue and as such is not responsible for the content posted on its web site and you nonetheless may be exposed to such materials and that you use the Swap Mamas service at your own risk.

General Conditions
• Swap Mamas reserves the right to modify or terminate the Swap Mamas service for any reason, without notice at any time.
• Swap Mamas reserves the right to alter these Terms of Use at any time.
• Swap Mamas reserves the right to refuse service to anyone for any reason at any time.
• Swap Mamas may, but has no obligation to, remove content and accounts containing content that Swap Mamas determines in Swap Mamas' sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property, or the Swap Mamas Terms of Use and Privacy Policy.
• By uploading images to Swap Mamas, you agree to allow other Swap Mamas users to view them and you agree to allow Swap Mamas to display the images and content on Swap Mamas and store the images, profile and other content.
• Swap Mamas allows only one account per individual. You agree to hold only one Swap Mamas account and to not misrepresent your identity. You must agree with and accept all of the terms and conditions contained the Terms of Use, the Privacy Policy of Swap Mamas, and other policy documents and community guidelines as posted on Swap Mamas before you may become a member of Swap Mamas. Swap Mamas may amend the Terms of Use and any other policy documents and community guidelines, at any time by posting the amended terms on Swap Mamas.

Membership Eligibility
Swap Mamas is a service and venue where all adult people (over the age of 18) are welcome to participate. We are committed to a policy of nondiscrimination for all persons regardless of race, sex, color, religion, creed, national origin or ancestry, marital status, sexual orientation, or disability. We encourage all of our coordinators to adopt a similar policy when regulating their swaps. Swap Mamas’ services are not available to children (persons under the age of 18) or to temporarily or indefinitely suspended Swap Mamas members.

Fees and Services
Joining Swap Mamas and swapping on Swap Mamas is free. Swap Mamas advocates a strict No Transfer of Funds Rule.

Release
Because Swap Mamas is a venue, in the event that you have a dispute with one or more users, you release Swap Mamas (and Swap Mamas’ officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Information Control
Swap Mamas does not control the information provided by other users that is made available through our system. You may find other users' information to be offensive, harmful, inaccurate, or deceptive. Please use caution, common sense, and practice safe trading when using Swap Mamas. Please note that there are also risks of dealing with underage persons or people acting under false pretense. Additionally, there may also be risks dealing with international trade and foreign nationals. By using Swap Mamas, you agree to accept such risks and that Swap Mamas (and our officers, directors, agents, subsidiaries, joint ventures and employees) is not responsible for any and all acts or omissions of users on Swap Mamas.

Breach (Breaking the Rules)
Without limiting other remedies available, Swap Mamas may, without prior notice, limit your activity, immediately remove you from swaps, warn Swap Mamas community of your actions, issue a warning, temporarily suspend, indefinitely suspend or terminate your account and refuse to provide our services to you if:
1. You breach this Terms of Use, the Privacy Policy, or other policy documents and community guidelines;
2. Swap Mamas is unable to verify or authenticate any of your contact information; or
3. Swap Mamas believes that your actions may cause financial loss or legal liability for you, Swap Mamas users or Swap Mamas.

Liability Limit
In no event shall Swap Mamas, and (as applicable) Swap Mamas subsidiaries, officers, directors, employees, or suppliers be liable for lost profits or any special, incidental, or consequential damages arising out of or in connection with our site, our services, or this agreement (however arising, including negligence).

Legal Compliance
You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of our service.
